No, Marc, don’t you see? The problem with NRS 41.635 *et seq.* is that it actually does something that couldn’t already be done with NRCP 12(b)(5). It’s fine that we give greater scrutiny to claims targeting speech than claim that don’t target speech, so long as we don’t give them any greater scrutiny than claims that don’t target speech. Doesn’t that make sense? We’re protecting speech by making sure we don’t protect it any more than any other activity!
