The recent story about an S&M practicioner’s untimely, and unfortunate, demise has garnered a lot of media attention, and some snarky guffaws in the blogosphere. I won’t link to the snarky — as this is a sad story, not one with any room for gloating. However, here are some of the more balanced stories on this event: CNN.com – Salon.com
Above the Law makes this insightful comment:
Moral of the story: If you’re into this sort of thing, before doing anything, make sure your partner signs a waiver, assumption of risk, and release of liability form. Then transmit an executed copy to a third party prior to the liaison, so there’s contemporaneous documentation. (source)
This is interesting commentary and got me thinking about liability for S&M related injuries. I should have a post ready sometime this week. Stay tuned.
