  1. It’s sort of ironic – Mary Ann Franks and company running around trying to ‘kill revenge porn’ and it’s 1st Amendment attys that really ended up killing it.

    I had a ? about your copyright posts but comments closed.
    What about Fair Use? And using for critiquing and well as if a copyright troll litigant claims loss but doesn’t show it and its their true intention to drain you of attorney fees; if a defendant sees this and lets say you Marc sued everyone like that one company did who owns the WTC photo.. And lets say you.. Time out.. I am all over the place.
    Lets say I heard about the media group who sued Sarah Palin and like CNN, FOX and everyone posted the photo.. (Or lets say they didn’t for that matter) they come after me.. Of course in the land of the court, my attorney files a (I cant remember the proper legal terms) motion to avoid costly legal expenses and trial and claim the fair use act etc. do you think a judge would agree? Do you think a judge would agree if Defendant was Pro Se?

    The problem with these default judgments against empty tubs is that you may be a long time collecting them. One of the defs may well be a guest of the state for a while, and I imagine that the web site has been shut down so there is no longer any income stream.

    Satisfying, yes, but generally clients enjoy checks a lot more than the satisfaction of admiring the judgment.
