Kenneth White brings a human side to the “involuntary porn” fight

Kenneth White is a certified First Amendment Bad Ass. In fact, that’s why I love being co-counsel with him. Another reason is that Ken has this streak in him that brings humility and humanity to my desire to scream murum aries attigit and run screaming at the other side, fully nude, carrying my sword like some hallucinogenic-addled gaul.

Well, Ken has done it again. In this post, he calls out Chance Trahan, half of the team behind isanybodydown.com. He doesn’t call him out as a punk, but as a dad. Ken actually manages to play the “family card” without playing it the wrong way.

Ken also notes that isanybodydown.com is, in fact, down.

As far as I am concerned, if it stays that way, then everyone should lay off Chance Trahan and Craig Brittain. If it goes back up, then I have plaintiffs now… and I have a costco sized box of the spirit of murum aries attigit.

    It’s up again.

    My offer to him remains. But for now, I think we work to connect victims with legal counsel, assist them in pursuing redress through the civil and criminal justice system, and continue to expose the people behind this extortion scam.

    It’s still up but timing out often, which leads me to suspect it was down for technical reasons and nothing to do with being a human being.

    Did anybody else notice this statement on the “jobs” portion of their website: “If you are or have ever been a member of law enforcement, any federal agency, etc. you are ineligible for this position and cannot contact us.” I primarily deal in corporate and finance law, but wouldn’t that statement alone violate 38 USC 4311(a)? I’m not sure if USERRA has a threshold number of employees like EEOA, or if anyone would have standing without actually trying to gain employment, but it might be something if anyone’s better than me at wading through employment law.

      Unfortunately, that Wikipedia article doesn’t meet Wikipedia’s “reliable source” standards, which require that “Articles should be based on reliable, third-party, published sources with a reputation for fact-checking and accuracy.”

    I mean, I think this site should be taken down, but I’m having trouble figuring out why one type of extortion (this) should draw First Amendment lawyers ire, yet there are countless mugshot websites that have been doing this same sort of things for years.

    hm, is anyone pursuing the child-pornography angle for these scumbags? At least for yougotposted.com (which I think is related to the same people as isanyonedown.com and so on, no?) there are some underage girls depicted, but is it hopeless to pursue legally (I am not a lawyer)? Ie. would they be able to claim no knowledge of the fact that the girl(s) (and probably guys as well) were underage, since it was “user submitted” (hrm hrm)?

    It would seem a somewhat more efficient strategy to me (again IANAL), if possible, to nail them for childporn instead of e.g. cybersquatting: It’s the content that’s really objectionable, not (so much) their business methods, IMO.
