No, I did not Author any Questions on the MBE

I read on a blog somewhere, that there was an MBE question that went something like this:

A woman wanted to get pregnant. A man, who had previously had a vasectomy, offered to have sex with her. He did not tell her that he was sterile. They had sex, and then the woman found out that the man was sterile. She wanted to bring rape charges against the man. (source – an anonymous reader)

One of the answers was “fraud in the inducement did not constitute rape.”

This fact pattern might sound awfully familiar to anyone who read Pickup Line Quagmire in Massachusetts. However, no, I do not draft MBE questions. Nevertheless, at least I know this much — loyal Legal Satyricon readers got at least one question right on the MBE.

    Thanks for deleting the comments Prof. But it was probably unnecessary. The pledge we signed was more of an acknowledgement that they owned the copyright and that we wouldn’t infringe it. (They didn’t want us taking the questions from the exam site and giving them to one of the bar prep courses.) I honestly don’t remember everything the pledge said, but it definitely did not say we could never discuss the questions or the exam.

    Alas, I don’t think this question appeared on my exam. Though I do recall at least one or two other questions I was able to answer from current events rather than my studying.

    And I followed that story rather closely because the idiot legislator who proposed it represents a district a lot of my friends live in.

    Siggghhh. I remember the political correctness starting immediately in my law school experience, when I sat down to take the LSAT. It is truly amazing that my eyes did not permanently roll into the back of my head. The MBE was of course no different, probably written by the same losers that dare to be different by uniformly dressing in black and hanging out by the Harvard Square T stop.
